An assault in the 2nd degree – dangerous weapon felony charge has been filed in Stevens County against 58-year-old James Henry Garberick of Buffalo, Minnesota for an incident at Pomme de Terre Park in Morris on July 22. He is charged with striking his cousin Mary Jyrkas with a two by four which had been in a bonfire, and punching Sandra Gonzalez in the face. Garberick was intoxicated during the incidents, according to the complaints. The maximum sentence is not less than 1 year and 1 day in prison nor more than 7 years and/or $14,000 fine. He is also charged with a misdemeanor assault in the 5th degree, That carries a maximum sentence of 90 days in jail and/or a $1,000 fine. Both victims sustained injuries in the encounter.
